Xsquash Privacy policy

Overview

Henix (or hereafter “we”, “us”), a French simplified joint-stock company, is committed to protecting the privacy of your data.
This Privacy Policy (or hereafter “policy”) explains collection, processing and treatment of personal information provided to us, or obtained through your use of our websites, services, products, marketing campaigns, events, webinars, or whenever you interact with Henix.
Please note that this Policy does not alter the terms of any other agreement that you may have with us, such as our General Terms and Conditions of Sale.

Key definitions

  • Personal information: Data relating to an identified or identifiable natural person.

  • Websites: All Henix websites under the following master domains: henix.com, squashtest.com.

  • Cookies: Small data files written to your computer’s memory.

Information we collect

Through the Xsquash plugin, the personal information we may collect includes the following:

  • The URL to access Squash on your servers;

  • Usage data and information about the systems running our products;

Through your eventual access to our helpdesk, in the case you acquired a License, we may collect:

  • The necessary details to contact you to carry out the service request, including support, assistance, training, demonstrations and consulting;

  • Information provided in feedback messages, comments, email or telephone conversations.

How we use the information collected

 

In order to provide you with our services and products, we must process the information we have collected. Part of this data might be personal information, and we will only use it for the purposes for which we collect it. Among those purposes are the following ones:

  • To provide the services and products requested;

  • To communicate with you;

  • Security purposes, i.e. checking someone’s digital identity or identity;

  • To address complaints and solve problems, may they be disagreement between parties or technical problems;

We might notify you about changes to our services, conditions or policies, in case you subscribed a License.

Henix is committed to keeping strict secrecy of information, documents, interviews, methods and knowledge we may have had access to as part of these contractual relations, and only disclose it to Henix’s employees as required to fulfil their missions.

We reserve the right to disclose or use your personal information if required by law, a court order, a judicial authority, a regulator or any legal obligation to which we are subject, or if we reasonably believe that disclosure or use is necessary to protect the rights, intellectual property or safety of Henix or to enforce the terms of Henix’s intellectual property licences. In such cases, we will, as far as is legally possible, inform you about such disclosure or use.

Information sharing

We do not share or disclose any of your personal information with third-parties except as described in this policy. We do not sell your personal information and we will not provide it to any third-party without your previous consent.

User control and rights on personal information

According to the French “data protection act” (known as “Loi informatique et libertés”), act nº78-17 of January 6th, 1978 in French legislation, and according to the General Data Protection Regulation (Regulation EU 2016/679) (the “GDPR”), you have the following rights regarding the personal information we might hold about you:

  • Right to know if we are indeed processing personal information about you;

  • Right to be informed about our privacy policy and practices;

  • Right to access your personal information and review it;

  • Right that we rectify your personal information if it is inaccurate or incorrect;

  • Right to opt-out of direct marketing communication, promotional emails or phone calls, processing for research or statistical purposes (unless a processing is for the establishment, exercise or defence of legal claims);

  • Right of erasure of your personal information, but only in specific circumstances, such as when it is no longer necessary in relation to the purpose for which it was originally collected, when you withdraw your consent and there is no other legal ground or obligation for this processing;

  • Right to request data portability, the right to obtain your personal information in a structured, commonly used and machine-readable format and to transfer it to another organisation without hindrance from us, where it is technically feasible. This right only applies where the use of your personal information is based on your consent or for the performance of a contract, and when the use of your personal information is carried out by automated means;

  • Right to be informed about any recipients to whom your personal information has been disclosed, if you request it. Moreover, if you request any rectification/removal of personal information or restriction of processing, we will communicate it to each of those recipients;

  • Right to withdraw at any time your consent to our processing of your personal information, if our processing is based on consent;

  • Right to lodge a complaint with and appeal to the relevant data protection supervisory authority on any of our use of your data.

You can exercise these rights using the contact details at the end of this Privacy Policy. For your protection, we may request specific information from you to confirm your identity before implementing any request made to exercise your rights detailed above.
In some cases, we may not be able to entirely remove your content or personal information, in which case we will let you know if we are unable to do so and why.

Security of your personal information

We take reasonable security precautions, including physical, electronic and managerial procedures, to help to protect your personal information from disclosure, misuse and handling that would be inconsistent with this policy and applicable laws, alteration, loss, or unauthorized access.
Nevertheless, full security cannot be guaranteed at 100%, especially with digital data, nor cannot be guaranteed that the communications between you and our servers are free from unauthorized interception by third parties.

Consent and acceptance of this policy

Please ensure that you agree with the contents of this policy and read it carefully.
If you do not fully agree with this policy, you should not use our services, websites and products. Your continuing of using those after having been informed of this policy implies acceptance of it and of its terms and contents.

Changes to this policy

We may edit, update or replace this policy at our sole discretion at any time (see Revision Date below, which is the date changes become effective) and post the revised version on our website. Should this policy significantly change, we will notify you by means of a notice on our website or by email.
